Introduction

Colored Pixels Studio built the Habitwise app as a freemium application with optional premium features. This SERVICE is provided by Colored Pixels Studio and is intended for use as is.

Throughout this document, “Colored Pixels Studio,” “we,” “our,” or “us” refers to the individual owner/developer operating under the brand name “Colored Pixels Studio” and any affiliated parties who contribute to the development, maintenance, or operation of the Habitwise app.

This page is used to inform visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decides to use our Service.

Privacy-First Design: Habitwise is designed with your privacy as a top priority. We do not collect personal information, do not require user accounts, do not display advertisements, and store all your data locally on your device only.

If you choose to use our Service, then you agree to the terms outlined in this policy. The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at Habitwise unless otherwise defined in this Privacy Policy.

Information Collection and Use

We do not collect any personal information.

Habitwise does not require you to create an account, provide an email address, or share any personal information. The app functions entirely offline and all your habit data remains on your device.

We do not:

Collect your name, email, phone number, or any personal identifiers
Track your location
Access your contacts, photos, or other device data
Use analytics or tracking services
Display advertisements or use advertising networks
Sync your data to any cloud servers
Share any information with third parties for marketing purposes

Locally Stored Data

All data you create within Habitwise is stored locally on your device using a secure local database (Hive). This includes:

Habit information (name, description, icon, color, frequency settings)
Your progress and completion history
Personal notes and reflections for each habit instance (Premium feature)
Reminder schedules and settings
App preferences (theme, display settings)
Anonymous install timestamp for app rating prompts

This data never leaves your device unless you explicitly choose to export it using the app’s backup feature. We have no access to your habit data, progress, or any information you enter into the app.

Subscription and Payment Processing

Habitwise offers optional premium features through in-app subscriptions. All payment processing is handled entirely by Apple (for iOS users) through the App Store or by Google (for Android users) through Google Play.

RevenueCat: We use RevenueCat as a subscription management service to verify premium entitlements. RevenueCat:

Receives an anonymous identifier generated by Apple or Google (not linked to your personal information)
Does not receive your name, email, payment details, or any personal information
Only verifies whether your device has an active premium subscription

User-Generated Content

The App allows you to create and store personal notes for each habit occurrence (Premium feature). This content:

Is stored locally on your device only
Is never transmitted to our servers or any third parties
Remains under your complete control
Can be deleted at any time by editing or deleting the associated habit
Is included in export files if you use the Backup feature
Should not contain sensitive medical, financial, or confidential information

Gesture Input: The App uses swipe gestures (swipe right to mark complete, swipe left to mark incomplete) as an input method for habit tracking. No gesture data, motion data, or interaction patterns are collected, stored, or transmitted.

No Advertising

Habitwise does not display any advertisements. We do not use any advertising networks, including but not limited to Google AdMob, Facebook Audience Network, AppLovin, or any other ad services.

We do not:

Collect data for advertising purposes
Share data with advertising networks
Track you across apps or websites
Request tracking permissions for advertising purposes

Home Screen Widgets

Habitwise offers Home Screen widgets (iOS) and App widgets (Android) as a premium feature that display your habit information. Widget data is:

Shared between the main app and widgets using secure local sharing mechanisms provided by the operating system
Stored entirely locally on your device
Never transmitted to external servers
Subject to the same local-only storage as the main app

Import and Export Feature

Habitwise provides a backup and restore feature (premium) that allows you to:

Export your habits and settings to a local backup file
Import data from a previously created backup file

These backup files are created and stored locally on your device. If you choose to share these files (via email, cloud storage, etc.), that is your choice and responsibility. We do not receive or store copies of your backup files.

Notifications

Habitwise uses local notifications to remind you about your habits. These notifications:

Are scheduled and delivered entirely on your device
Do not use push notification servers
Do not transmit any data to external servers
Can be disabled at any time through your device Settings or within the app

Service Providers

We may employ third-party companies and services for the following reasons:

To manage subscription services and verify premium entitlements (RevenueCat)
To process payments through the Apple App Store or Google Play Store

These third parties have access only to anonymous identifiers necessary to perform their functions. They are obligated not to disclose or use the information for any other purpose.

Data Security

Your data security is inherently protected by our local-only storage approach:

All data remains on your device and is protected by your device’s security features
No data transmission means no risk of interception during transfer
No cloud storage means no risk of server breaches affecting your data
Your device’s passcode, Face ID, Touch ID, fingerprint, or other biometric security features protect access to your data

However, please note that no method of electronic storage is 100% secure. You are responsible for maintaining the security of your device.

Mental Health Disclaimer

Habitwise is not a mental health tool and is not designed to address mental health conditions.

Habit tracking may create pressure or stress for some individuals – use at your own discretion
Streaks, statistics, and completion rates are motivational features only
These metrics are not measures of self-worth, success, or personal value
The app is not a substitute for mental health treatment, therapy, or counseling
We are not liable for any stress, anxiety, negative emotions, or mental health impacts arising from app usage
If you experience negative psychological effects from habit tracking, please discontinue use and consult a mental health professional

Data Accuracy Disclaimer

All data, statistics, and calculations provided by Habitwise are APPROXIMATE and may contain errors.

Streak counts, completion percentages, and insights are estimates only
Calendar calculations may be affected by timezone changes, daylight saving time, or device settings
We do not guarantee the accuracy, completeness, or reliability of any data displayed
Do not rely on app data for any important decisions
We are not liable for any consequences resulting from data inaccuracies

Notification and Reminder Disclaimer

CRITICAL: Notifications and reminders are provided on a best-effort basis and are NOT guaranteed.

Notification delivery depends on operating system behavior, which we do not control
Device settings, battery optimization, Do Not Disturb mode, Focus modes, and other system features may prevent or delay notifications
Operating system updates may affect notification behavior without notice
We cannot guarantee that any notification will be delivered at the scheduled time or at all
DO NOT rely on this app for time-critical or life-critical reminders, including but not limited to: medication schedules, medical appointments, safety-related tasks, legal deadlines, or any situation where a missed reminder could cause harm
You are solely responsible for your own tasks, habits, and schedules

Data Loss Disclaimer

Your data is stored locally on your device. This means it can be permanently lost.

Deleting the app will permanently delete all your data
Device damage, loss, theft, or malfunction may result in permanent data loss
Operating system updates or reinstallation may result in data loss
We do not provide cloud backup services and cannot recover lost data
You are solely responsible for backing up your data using the Export feature
We strongly recommend creating regular backups
We are not liable for any data loss, corruption, or inability to recover data

Device Performance Disclaimer

We are not liable for any effects on your device’s performance, including but not limited to:

Battery consumption from app usage, widgets, or notifications
Storage space used by the app and your habit data
Any impact on device speed or responsiveness
Interactions with other apps or system functions

You are responsible for managing your device’s resources and storage.

Subscription Disclaimer

Premium features are provided “as is” and may change over time
We reserve the right to modify, add, or remove premium features
All payments are non-refundable except as required by Apple’s or Google’s policies
Refund requests must be directed to Apple or Google, not Colored Pixels Studio
We do not store payment information and cannot process refunds directly
Subscription status depends on RevenueCat, Apple, and Google services, which may experience outages
We are not liable for service interruptions affecting subscription verification

Limitation of Liability

PLEASE READ THIS SECTION CAREFULLY. IT LIMITS OUR LIABILITY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

AS-IS BASIS: Habitwise is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
NO WARRANTIES: We do not warrant that the app will be uninterrupted, error-free, secure, accurate, reliable, or free from viruses or other harmful components.
LIMITATION OF DAMAGES: In no event shall Colored Pixels Studio, its owner, affiliates, or contributors be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use or inability to use the app.
MAXIMUM LIABILITY: Our total cumulative liability to you for any and all claims arising from or related to the app shall not exceed the amount you paid to us for premium features in the twelve (12) months preceding the claim, or fifty US dollars ($50.00), whichever is less.
ESSENTIAL PURPOSE: The limitations set forth in this section shall apply even if any limited remedy fails of its essential purpose.
JURISDICTIONAL LIMITATIONS: Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. If these laws apply to you, some or all of the above disclaimers or limitations may not apply, and you may have additional rights.

Indemnification

You agree to defend, indemnify, and hold harmless Colored Pixels Studio, its owner, affiliates, and contributors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney’s fees) arising from:

Your use of and access to the app
Your violation of any term of this Privacy Policy or Terms of Service
Your violation of any third-party right, including any intellectual property or privacy right
Any claim that your use of the app caused damage to a third party
Any decisions or actions you take based on data or information from the app

This indemnification obligation will survive the termination of your use of the app.

Governing Law and Dispute Resolution

Governing Law: This Privacy Policy and any disputes arising from or relating to it or the app shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.

Jurisdiction: You agree that any legal action or proceeding arising out of or relating to this Privacy Policy or the app shall be brought exclusively in the state or federal courts located in New Jersey, United States, and you consent to the personal jurisdiction of such courts.

Informal Resolution: Before filing any legal claim, you agree to attempt to resolve the dispute informally by contacting us at the email address provided below. We will attempt to resolve the dispute informally within sixty (60) days.

Waiver of Class Actions: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

Your Data Rights and Controls

Because all your data is stored locally on your device, you have complete control over it:

Deleting Your Data:

Delete individual habits within the app (Archive → Delete Permanently)
Delete all data by uninstalling the app
No request to us is necessary – you have direct control

Exporting Your Data:

Use the Export feature in Settings to create a backup file (Premium feature)
This file contains all your habits, progress, and settings
You can store this file wherever you choose

Subscription Management:

iOS: Manage or cancel subscriptions through Settings → [Your Name] → Subscriptions, or use the “Manage Subscription” option within the app
Android: Manage or cancel subscriptions through Google Play Store → Menu → Subscriptions, or use the “Manage Subscription” option within the app

Notification Controls:

iOS: Enable or disable notifications in Settings → Notifications → Habitwise
Android: Enable or disable notifications in Settings → Apps → Habitwise → Notifications
Manage individual habit reminders within the app

Children’s Privacy

Habitwise is not directed at children under the age of 13. We do not knowingly collect personally identifiable information from children under 13.

Since Habitwise does not collect any personal information from any users, there is no risk of children’s personal data being collected or stored.

If you are a parent or guardian and believe your child has somehow provided personal information through the app, please contact us so we can investigate and take appropriate action.

Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the “Last Updated” date.

You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.

Your continued use of the app after any changes constitutes your acceptance of the new Privacy Policy.
