Terms and Conditions for Lumentime

Acceptance of Terms

By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Colored Pixels Studio.

Throughout this document, “Colored Pixels Studio,” “we,” “our,” or “us” refers to the individual owner/developer operating under the brand name “Colored Pixels Studio” and any affiliated parties who contribute to the development, maintenance, or operation of the Lumentime app. These terms protect both the brand name “Colored Pixels Studio” AND the individual developer personally from ANY and ALL liability, claims, damages, or legal actions.

Colored Pixels Studio is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

When you install or use this app, it is assumed that you have gone through the Introduction section of this app. Colored Pixels Studio will not hold any responsibility if you do not find your desired feature(s) in the app or if the app doesn’t function as you want. App Purpose and Functionality

Lumentime is a relaxation and ambient lighting tool that allows users to create customizable virtual lamps for sleep, focus, and mood enhancement. The App provides various lighting effects, timers, and ambient sounds for relaxation purposes only.

Free vs Pro Features

Free Users Receive:

A maximum of 2 custom lamps (attempting to create more will be blocked)
Full lamp type only
Basic timer functionality without auto-dimming
A limited set of basic ambient sounds
Full screen mode access with advertisements
Advertisement-supported experience throughout the app
The ability to preview Pro lamp types and Flow Mode in the lamp settings screen, as described under “Previewing Pro Features” below

Pro Users (One-time purchase) Receive:

Unlimited custom lamps
All lamp types (Full, LED, Neon and Glass)
Auto dimming with gradual brightness reduction on a timer
Flow mode with breathing light effects
All ambient sounds including Pro sounds
Completely ad-free experience
Full screen mode without any advertisements
All advanced customization options and settings
The ability to use the app without an active internet connection, as described under “Internet Connection Requirements” below

Feature sets, lamp limits, sound libraries, pricing, and availability may be changed, added to, or removed by us at any time, for any reason, without notice, and may differ between app versions, platforms, and regions.

Previewing Pro Features

To help you decide whether Pro is right for you, the lamp settings screen allows free users to select Pro lamp types and Flow Mode and to see a live preview of how they would look. You acknowledge and agree that:

This preview is provided purely so that you can evaluate Pro features before purchasing, and does not grant you any entitlement to those features
Attempting to save a lamp that uses a Pro lamp type or Flow Mode without an active Pro purchase will not save those settings, and you will instead be shown an upgrade prompt
The ability to preview a feature is not a promise that the feature is included in the free version, nor an offer to provide it free of charge
We may add, change, restrict, or remove the preview capability at any time without notice
Any attempt to circumvent, hack, patch, or otherwise bypass the save restriction in order to use Pro features without purchasing them is a breach of these Terms

Internet Connection Requirements

The App has different connectivity requirements depending on whether you have purchased Pro:

FREE VERSION REQUIRES INTERNET: Because the free version is advertisement supported, an active internet connection is required to use it. While your device is offline, the free version will display a “no internet connection” screen and the App’s lamp features will not be available to you. This is an intended limitation of the free version and not a defect
PRO VERSION WORKS OFFLINE: Once your Pro purchase has been successfully verified online at least once, the App records that result locally on your device so that Pro features continue to work without a connection
FIRST VERIFICATION REQUIRES INTERNET: Immediately after purchasing, after reinstalling the App, or when installing on a new device, an internet connection is required before Pro status can be confirmed. Until that first successful check completes, the App will treat you as a free user
NO GUARANTEE OF OFFLINE AVAILABILITY: We do not warrant that offline Pro access will function in all circumstances, on all devices, or in all future versions of the App, and we accept no liability for any inability to access Pro features while offline
NO LIABILITY FOR CONNECTIVITY: We accept no responsibility whatsoever for your inability to use the App due to lack of internet connectivity, network outages, carrier issues, data limits, roaming restrictions, firewalls, or any other connectivity factor outside our control

No Cloud Services or User Accounts

IMPORTANT – READ CAREFULLY:

NO CLOUD BACKUP: We do not provide any cloud backup, cloud storage, or cloud synchronization services
NO USER ACCOUNTS: The app does not require or support user account creation, login credentials, or personal identification
NO CROSS-DEVICE SYNC: Your lamp configurations will NOT sync between devices – each device is completely independent
LOCAL STORAGE ONLY: All your lamp data is stored locally on your device using an on-device database, and your app preferences are stored using your device’s standard local preference storage
PERMANENT DATA LOSS WARNING: If you uninstall the app, reset your device, clear app data, or lose your device, ALL your lamp configurations will be PERMANENTLY LOST with no way to recover them
NO RESPONSIBILITY FOR DATA LOSS: We accept absolutely NO responsibility for any data loss, regardless of the cause

Important Limitations:

NOT A MEDICAL DEVICE: Lumentime is NOT a medical device or therapeutic treatment. It is designed for relaxation and ambiance only and should not be used to diagnose, treat, cure, or prevent any medical condition.
DEVICE BRIGHTNESS CONTROL DISCLAIMER: The app includes an optional toggle that allows the app to adjust your device’s screen brightness to match your lamp settings. This feature is disabled unless you choose to enable it, can be disabled at any time, and is used entirely at your own risk. It may impact battery life, device temperature, device performance, display longevity, and eye comfort.
NO LIABILITY FOR HEALTH EFFECTS: Colored Pixels Studio expressly disclaims any responsibility for eye strain, vision damage, seizures, photosensitive reactions, headaches, migraines, dizziness, nausea, sleep disruption, or any other health effects that may result from using the app’s lighting features, brightness control, animated or pulsing light effects, or ambient sounds, especially at high brightness or volume levels or for extended periods.
ANIMATED AND PULSING LIGHT EFFECTS: Flow Mode and certain other features produce continuously changing brightness and animated light effects. Animated, pulsing, or flickering light can trigger photosensitive epileptic seizures, migraines, dizziness, nausea, or visual discomfort in susceptible individuals, including those with no prior history of such reactions. You use these features entirely at your own risk and should discontinue use immediately and consult a medical professional if you experience any adverse reaction.
SCREEN BURN-IN AND DEVICE DAMAGE: Displaying bright, static, or high-contrast content for extended periods may cause permanent and irreversible screen burn-in, pixel degradation, display damage, overheating, and battery degradation. This risk is inherent to your device’s display technology and is not something we can prevent or repair. We accept no liability of any kind for such damage.
NO PROFESSIONAL REPLACEMENT: This App is not a substitute for professional medical advice, sleep therapy, light therapy treatments, or other professional wellness services. It should not be used as a replacement for medical treatment or professional consultation.
TIMER AND NOTIFICATION RELIABILITY: The timer, auto-dimming, and any notifications are provided for convenience and relaxation routines only. Their accuracy and delivery depend on your device, operating system, background execution limits, battery optimization settings, Do Not Disturb modes, and other factors outside our control. They must never be relied upon for critical time-sensitive activities, medical timing, medication reminders, wake-up alarms, cooking, or safety applications.
AMBIENT SOUND LIMITATIONS: Ambient sounds are provided for relaxation only and are not a treatment for any condition. Playback may be interrupted by your device, other apps, phone calls, or system settings. Prolonged listening, particularly at high volume or through headphones, may cause hearing damage.

By using the App, you acknowledge that you understand these limitations and use the app entirely at your own risk.

Pro Purchase Terms

Lumentime offers a one-time Pro purchase that removes advertisements and unlocks premium features including unlimited lamps, all lamp types, auto dimming, flow mode, and all ambient sounds. By purchasing Pro access, you agree to the following terms:

Pro Purchase and Billing

One-Time Purchase: Lumentime Pro is offered as a one-time purchase to unlock premium features
NO SUBSCRIPTION, NO AUTO-RENEWAL: Lumentime Pro is not a subscription. There is no recurring billing, no renewal, and nothing to cancel
Billing: Purchases are processed through your device’s app store (Google Play Store or Apple App Store)
Lifetime Access: Pro features are unlocked for the lifetime of the app on your app store account, subject to these Terms
Payment: Payment will be charged to your app store account upon confirmation of purchase
Pricing and Currency: The price shown in the App is the price set for your region by your app store, in your local currency, and includes or excludes taxes according to your app store’s rules and your local law. Prices differ between countries and currencies and are subject to app store pricing tiers and exchange rate adjustments outside our control
Price Changes: We reserve the right to change pricing for new purchases at any time, with notice only where required by applicable law. A change in price does not entitle you to a refund or to any credit if you purchased at a different price, and we may run promotional or discounted pricing at any time without obligation to extend it to earlier purchasers
NO PERSONAL DATA COLLECTION: We do not collect or store your payment information, app store credentials, or any personal financial data

Pro Account Management

Account Management: Pro status is tied to your app store account (Google Play or Apple ID) through the RevenueCat service
Device Access: Your Pro purchase can be accessed on any device logged into the same app store account
Restore Purchases: You can restore your Pro status on new devices using the “Restore Purchase” option in the app’s Pro screen. Selecting this option may prompt you to sign in to your app store account; this sign-in is handled entirely by your app store and we never see your credentials
Restore Limitations: Restoring requires an active internet connection and the same app store account used for the original purchase. We are not responsible if a restore fails due to app store issues, account changes, region changes, refunds, or third-party service outages
Offline Verification: After a successful online verification, the App stores the result locally so Pro features remain available offline. This local record is not proof of purchase, confers no rights of itself, and may be reset or revalidated at any time
Refunds: Refund requests are subject to the app store’s refund policy (Google Play or Apple App Store) – we have no control over refund decisions and do not issue refunds directly
Effect of Refund: If your purchase is refunded, reversed, charged back, or otherwise cancelled by your app store, your Pro entitlement ends and the App will revert to the free version, including advertisements and the free feature limits, once it is next able to verify your status online
NO LOGIN REQUIRED: Pro verification occurs automatically through your app store without requiring any login from you

Pro Features

Ad Removal: Pro purchase removes advertisements from the app
Unlimited Lamps: Create unlimited custom lamps (the free version is limited to 2 lamps)
All Lamp Types: Access to Full, LED, Neon and Glass lamp types
Auto Dimming: Gradual brightness reduction with timer functionality
Flow Mode: Breathing light effects for relaxation
Premium Sounds: Access to all ambient sounds including Pro sounds
Full Screen Mode: Full screen mode without advertisements
Offline Use: Continued use of the App without an active internet connection, subject to the “Internet Connection Requirements” section above
Advanced Features: All customization options and advanced settings

Existing Lamps and Feature Changes

Lamp Limit Changes: If we reduce the number of lamps available to free users, any lamps you already created above the new limit will remain on your device, but you will not be able to create additional lamps until you are below the limit or purchase Pro
Loss of Pro Access: If your Pro entitlement ends for any reason, lamps that use Pro lamp types or Pro features will remain stored on your device but may no longer be editable or saveable until Pro access is restored
No Guarantee of Continuity: We do not guarantee that any lamp, configuration, or feature created under one version of the App will remain available, editable, or functional in any future version

Pro Purchase Changes and Termination

Feature Changes: We reserve the right to add, modify, or remove Pro features at any time. A Pro purchase does not guarantee the permanent availability of any specific feature
Service Termination: We reserve the right to terminate Pro services or the app itself at any time
Account Termination: We may terminate your Pro access if you violate these terms
Data Management: RevenueCat, our purchase management service, handles customer identification and Pro entitlement status

By purchasing Pro features, you acknowledge that you understand the purchase terms and agree to the billing terms of your respective app store.

App Review Prompts and Optional Feedback

The App may occasionally invite you to rate it or to send us feedback. By using the App you acknowledge and agree that:

Review Prompts Are Optional: You are never required to rate or review the App. Declining, dismissing, or ignoring any prompt has no effect on any feature, and no feature is withheld, restricted, or unlocked based on whether you leave a review
Store Review Prompt: The App may trigger your device’s standard operating-system review prompt. That prompt is presented and controlled entirely by Apple or Google, who limit how often it can appear. We do not control its timing or appearance, do not receive any information about your response, and cannot guarantee it will appear at all
Developer Message: The App may display an in-app message from the developer inviting you to leave a review or send feedback. It can be dismissed at any time
Timing Data Stays Local: The App keeps counters on your device to decide when to show these prompts. These counters never leave your device and contain no personal information
Optional Feedback Email: The App provides an option to send us feedback by email. Choosing it opens a draft message in your own email application containing technical information about your device and app installation. Nothing is transmitted to us unless you choose to send that message yourself, and you may read, edit, or delete any part of the draft before sending. Full details of what the draft contains are set out in our Privacy Policy
No Obligation to Respond: We read feedback where we are able to, but we are under no obligation to respond to, act on, or implement any suggestion, bug report, or request you send us
Feedback Licence: Any ideas, suggestions, feature requests, or other feedback you voluntarily send us may be used by us freely, without restriction, attribution, compensation, or obligation of confidentiality
Honest Reviews Only: You agree not to submit false, fraudulent, incentivised, or misleading reviews about the App

Data Storage and Security

The Lumentime app stores and processes data locally on your device to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Lumentime app won’t work properly or at all.

All lamp configurations, settings, and user data are stored locally on your device. We do not access or collect your saved lamp configurations. Data will be lost if the App is uninstalled, app data is cleared, or if your device is reset.

The app does use third party services that declare their own Terms and Conditions.

Lumentime contains advertisements for free users. Pro users will not see advertisements. We use Google AdMob as our primary advertising platform, with AppLovin and Facebook Audience Network serving ads through AdMob mediation. By using the app, you acknowledge and agree that:

Advertisements will be displayed within the App for free users
Advertisements may appear as banners and as full screen interstitial advertisements, including when entering full screen mode and when saving lamp settings
Advertisements may interrupt your use of the app, including timers, sounds, and lamp display, and we accept no responsibility for any such interruption or its consequences
An active internet connection is required for the free version of the App, because advertisements must be loaded in order for the App to be used
The advertising partners used, the ad formats displayed, and the availability of advertising may vary by region, device, platform, and app version, and may change at any time without notice
Advertisement content is controlled by third-party providers (including Google AdMob, AppLovin, and Facebook Audience Network) and not by Colored Pixels Studio
We are not responsible for the content, accuracy, appropriateness, decency, legality, or safety of advertisements
Advertisements may use your device identifier and other non-personal information for targeting
Interaction with advertisements is at your own risk
Third-party advertising providers may collect and process data according to their own privacy policies and terms of service

Device Identifiers and Ad Targeting

Our advertising partners may collect and use the following for ad targeting and measurement:

Google Advertising ID (GAID) on Android devices
Apple Identifier for Advertisers (IDFA) on iOS devices
Device model, operating system version, and technical specifications
IP address and general location information
App usage patterns and interaction data
Cross-app tracking and measurement data
Ad performance analytics and attribution data

Consent and User Controls

For users in the European Union and other regions where consent is required:

You will be presented with a consent dialog when first using the app, before the introductory screens, and no advertisement is requested from any advertising partner until that process has completed
You can choose to accept or decline personalized advertising
Declining personalized ads means you’ll still see ads, but they won’t be based on your interests
You can change your consent preferences through the “Ad Privacy Options” in the app’s settings section
Your consent choices apply only to this app and are stored locally on your device
Pro users do not see advertisements regardless of consent choices

Apple App Tracking Transparency (iOS):

On iOS devices, the app may present Apple’s App Tracking Transparency prompt
Your device’s advertising identifier (IDFA) is only accessible to our advertising partners if you allow tracking
If you decline, you will still see advertisements, but they will not be personalized
You can change this choice at any time in your device settings

Facebook Audience Network Terms:

Our app may display ads from Facebook’s Audience Network through Google AdMob mediation
Facebook may serve advertisements based on information collected about your device, app usage, and potentially your Facebook account if you have one
Facebook may use device identifiers, cookies, and similar technologies to enhance ad personalization
You may be subject to Facebook’s Terms of Service and Privacy Policy when interacting with Facebook advertisements

AppLovin Specific Terms:

AppLovin may serve personalized advertisements based on information collected about your device and app usage
AppLovin may use cookies, mobile identifiers, and similar technologies to enhance ad targeting
You may be subject to AppLovin’s Terms of Service and Privacy Policy when interacting with AppLovin advertisements
By using the App, you acknowledge that AppLovin may collect, use, and share certain device data and app usage information for advertising purposes
AppLovin may share information with its partners to improve ad targeting and measurement

Service Limitations and Comprehensive Liability Disclaimers

YOU SHOULD BE AWARE THAT THERE ARE VIRTUALLY NO CIRCUMSTANCES UNDER WHICH COLORED PIXELS STUDIO OR THE INDIVIDUAL DEVELOPER WILL TAKE RESPONSIBILITY FOR ANYTHING THAT GOES WRONG. THE FOLLOWING ARE EXTENSIVE BUT NOT EXHAUSTIVE DISCLAIMERS:

Internet and Connectivity: Certain functions of the app require an active internet connection, and the free version of the app requires an active internet connection in order to be used at all. The connection can be Wi-Fi, or provided by your mobile network provider, but Colored Pixels Studio cannot take responsibility for the app not working at full functionality, or at all, if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

Data Charges: If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Device Responsibility: Along the same lines, Colored Pixels Studio cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Colored Pixels Studio cannot accept responsibility.

Data Loss: Colored Pixels Studio will not take responsibility for any kind of data loss due to your device’s internal functionality. In case of an event such as formatting of your device, or the data for Lumentime is cleared from the settings, etc., Colored Pixels Studio will not take any responsibility for this loss or to retrieve such data.

Third Party Dependencies: With respect to Colored Pixels Studio’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide services to us so that we can make them available to you. Colored Pixels Studio accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

Device Brightness Control: The brightness control toggle is an optional feature that you choose to enable at your sole discretion. When enabled, the app will adjust your device’s screen brightness. We accept no liability whatsoever for any eye strain, discomfort, vision problems, temporary or permanent vision loss, seizures, photosensitive reactions, headaches, migraines, dizziness, nausea, sleep disruption, battery drain, device overheating, screen burn-in, pixel damage, display degradation, permanent device damage, or any other issue of any kind that may result from using this feature. Users should exercise caution and disable this feature immediately if they experience any discomfort.

Animated and Pulsing Light Effects: Flow Mode and other animated lighting features produce continuously changing brightness. We accept no liability whatsoever for any seizure, photosensitive reaction, migraine, headache, dizziness, nausea, visual disturbance, or other health effect of any kind arising from these effects, whether or not you have any prior history of such reactions.

Screen Burn-In and Display Damage: This app is designed to display bright and often static content for extended periods. This carries an inherent risk of permanent screen burn-in, image retention, ghosting, pixel degradation, and other irreversible display damage, particularly on OLED and AMOLED screens. You accept this risk entirely, and we accept no liability for any display damage, repair costs, device replacement costs, or loss of device value.

Timer Accuracy and Reliability: While we strive to provide accurate timer functionality, timer accuracy and delivery may be affected by device performance, background app restrictions, battery optimization settings, power saving modes, Do Not Disturb settings, operating system updates, and countless other system factors beyond our control. You should NEVER rely on the app’s timer, auto-dimming, or notifications for critical, safety-related, or medical timing needs, cooking, wake-up alarms, medication reminders, or any situation where failure could cause harm, inconvenience, or loss.

Ambient Sound Quality: Sound quality and playback reliability may vary based on device capabilities, audio settings, speaker or headphone quality, other apps, and device age. We are not responsible for audio quality issues, playback interruptions, hearing damage, tinnitus, audio distortion, compatibility problems with your device’s audio system, or any hearing-related health issues.

Health and Wellness Effects: We make absolutely no claims about therapeutic benefits, sleep improvement, stress reduction, pain relief, mood enhancement, productivity increases, or other health effects of using the app. Results may vary dramatically between individuals, and you should consult healthcare professionals for any medical concerns. We are not responsible for any adverse health effects, worsening of existing conditions, or failure to achieve desired wellness outcomes.

Advertising Content: We are not responsible for the content, accuracy, appropriateness, decency, legality, or safety of any advertisements displayed in the App, nor for any interruption they cause to app functionality. Advertisements are provided by third-party services including Google AdMob, AppLovin, and Facebook Audience Network, which have their own terms and privacy policies. We have no control over ad content and accept no responsibility for any consequences of viewing or interacting with advertisements.

Pro Purchase Services: We are not responsible for billing issues, refund disputes, payment processing problems, unauthorized charges, billing errors, failed or delayed purchase restoration, purchase verification failures, loss or unavailability of offline Pro access, account suspensions, or any financial issues, as these are handled by your respective app store (Google Play or Apple App Store) and by RevenueCat. For purchase-related issues, please contact your app store’s customer support directly.

Software Updates and Compatibility: We are not responsible if app updates break functionality on your device, cause incompatibility issues, worsen performance, consume more battery, remove features, or introduce new bugs. Device compatibility may change without notice, and older devices may lose support.

User Error and Misuse: We are not responsible for any consequences resulting from your failure to read instructions, ignoring warnings, using the app inappropriately, using the app while impaired, using the app in dangerous situations, sharing your device unsupervised with children, or any other form of user error, negligence, or poor judgment.

Prohibited Uses and User Responsibilities

You agree not to use the App:

For any unlawful purpose or in violation of any applicable laws or regulations
To infringe the intellectual property rights of others or us
To transmit viruses, malware, spyware, or other malicious code
To interfere with the operation of the App or other users’ experience
To automate access or use the App through bots, scripts, or automated tools
As a medical device, therapeutic tool, or for medical treatment purposes
For emergency lighting, safety applications, critical timing needs, or life-safety systems
As a substitute for professional light therapy, sleep therapy, or medical treatment
In any manner that could disable, overburden, damage, or impair the App or our systems
For commercial purposes beyond personal use without explicit written permission
To create derivative works, reverse engineer, or extract functionality from the App
To block, disable, circumvent, or otherwise interfere with advertisements in the App (for free users)
To circumvent, hack, exploit, or attempt to bypass Pro purchase restrictions, lamp limits, save restrictions on previewed Pro features, offline verification, or payment systems
To manipulate your device’s date, time, network settings, or system state in order to obtain Pro features, extend offline Pro access, or otherwise avoid purchase verification
To share Pro access credentials or Pro features with others
To attempt to reverse engineer, decompile, or extract Pro feature functionality
To extract, copy, distribute, share, redistribute, or reuse the ambient sounds, graphics, animations, developer photographs, or any other content included in the app. Ambient sounds and all in-app content are licensed to you for personal in-app use only
In environments where screen brightness changes could pose safety risks or endanger others
If you have photosensitive epilepsy, seizure disorders, or other light-sensitive conditions without proper medical consultation
While driving, operating machinery, or in any situation requiring full attention and alertness
As a replacement for proper room lighting, reading lamps, work lighting, or safety lighting
In professional settings where color accuracy, timing precision, or lighting reliability is critical
To cause intentional screen burn-in or damage to your or others’ devices
To create excessive load on your device’s battery, processor, or display systems
In any way that violates the terms of service of app stores, advertising networks, or third-party services
To exploit bugs, glitches, or unintended functionality for any purpose
To provide false information, fake reviews, incentivised reviews, or misleading feedback about the app
To use the app as evidence, documentation, or proof for any legal, medical, or professional purposes
To rely on the app for time-sensitive communications, reminders, or critical notifications
In any manner that could result in injury, property damage, financial loss, or other harm to yourself or others

Additional User Responsibilities:

You are responsible for ensuring your device is suitable for running the app
You are responsible for all data charges, battery usage, and device wear from app usage
You are responsible for monitoring your own health and discontinuing use if you experience any adverse effects
You are responsible for supervising any children or others who may use your device with the app
You are responsible for backing up any important data before using the app
You are responsible for reading and understanding all warnings, disclaimers, and instructions
You are responsible for reviewing the contents of any feedback email before you choose to send it to us

Comprehensive Indemnification

You agree to indemnify, defend, and hold harmless Colored Pixels Studio (as a brand name), the individual developer operating under this brand, and any affiliates, contractors, or service providers from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from or relate to:

Your use or misuse of the App in any way, shape, or form
Your violation of these Terms or any applicable laws or regulations
Your violation of any rights of another person, entity, or organization
Your use of device brightness control features or any resulting effects of any kind
Your use of Flow Mode or any other animated or pulsing lighting feature and any resulting effects of any kind
Any health effects, eye strain, discomfort, injury, seizures, or medical issues resulting from app usage
Any screen burn-in, display damage, battery damage, overheating, or device failure
Your breach of any part of these Terms, even minor or technical violations
Your interaction with any advertisements displayed in the App or consequences thereof
Any Pro purchase-related disputes, billing issues, restore failures, verification failures, or refund claims
Your use of Pro features or services in any manner
Any attempt by you to circumvent purchase restrictions, save restrictions, lamp limits, or offline verification
Any decisions or actions taken based on timer, auto-dimming, or notification functionality provided by the App
Your use of the app for purposes we have specifically disclaimed or prohibited
Any damage to your device, data loss, or technical problems resulting from app usage
Any consequences of sharing your device with others who use the app
Any data charges, roaming fees, or other costs incurred from app usage
Any consequences of using the app while your judgment is impaired by alcohol, drugs, fatigue, or medical conditions
Any consequences of using the app in inappropriate environments or dangerous situations
Any reliance on the app for critical functions, medical purposes, or professional activities
Any consequences of app malfunctions, bugs, crashes, or unexpected behavior
Any content you voluntarily send to us, including by email through the app’s optional feedback feature
Any consequences of third-party service failures or changes (app stores, ad networks, purchase management, etc.)
Any consequences of operating system updates, device incompatibilities, or hardware failures
Any consequences of your failure to read, understand, or follow warnings and instructions
Any legal actions, regulatory investigations, or complaints related to your app usage
Any intellectual property infringement claims related to your use of the app
Any privacy violations or data security issues on your device
Any consequences whatsoever, however remote, indirect, or unforeseeable, connected to your use of this app

This indemnification obligation will survive the termination of these Terms and your use of the App. This indemnification applies regardless of the legal theory under which liability might be imposed, including but not limited to negligence, strict liability, breach of contract, or any other cause of action.

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, COLORED PIXELS STUDIO AND THE INDIVIDUAL DEVELOPER DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND QUIET ENJOYMENT.

COLORED PIXELS STUDIO DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, VIRUS-FREE, OR THAT ANY DEFECTS IN THE APP WILL EVER BE CORRECTED. COLORED PIXELS STUDIO DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE APP IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, SAFETY, OR OTHERWISE.

THIS DISCLAIMER APPLIES TO ALL FEATURES OF THE APP, INCLUDING BUT NOT LIMITED TO LIGHTING EFFECTS, LAMP TYPES, FULL SCREEN MODE, TIMER AND AUTO DIMMING FUNCTIONALITY, FLOW MODE, AMBIENT SOUNDS, DEVICE BRIGHTNESS CONTROL, PRO SERVICES, OFFLINE PRO ACCESS, PURCHASE VERIFICATION, USER INTERFACES, DATA STORAGE, AND ANY OTHER FUNCTIONALITY PROVIDED.

WE SPECIFICALLY DISCLAIM ANY WARRANTIES REGARDING:

The app’s suitability for any particular purpose or use case
The accuracy or reliability of any timers, alarms, or timing functions
The safety of using device brightness control, animated lighting, or lighting effects
The quality, appropriateness, or safety of ambient sounds
The app’s compatibility with your specific device or operating system
The app’s performance under various environmental conditions
The security of data stored on your device by the app
The app’s compliance with any specific accessibility requirements
Any health, wellness, or therapeutic benefits from app usage
The continued availability of any feature, including Pro features
The availability or reliability of offline Pro access or purchase verification
The app’s continued availability or functionality in the future

Maximum Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COLORED PIXELS STUDIO (AS A BRAND), THE INDIVIDUAL DEVELOPER, OR ANY AFFILIATES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

LOSS OF PROFITS, REVENUE, OR BUSINESS OPPORTUNITIES

SCREEN BURN-IN, DISPLAY DAMAGE, OVERHEATING, OR BATTERY DEGRADATION
TIMER INACCURACY, FAILURE TO FUNCTION, OR RELIANCE ON TIMING FEATURES
RELIANCE ON THE APP FOR ANY CRITICAL, IMPORTANT, OR TIME-SENSITIVE PURPOSES
SERVICE INTERRUPTIONS, OUTAGES, OR TECHNICAL FAILURES
INABILITY TO USE THE FREE VERSION OF THE APP WHILE OFFLINE
APP CRASHES, BUGS, GLITCHES, OR UNEXPECTED BEHAVIOR
OPERATING SYSTEM UPDATES OR DEVICE COMPATIBILITY ISSUES
ADVERTISEMENTS DISPLAYED IN THE APP OR YOUR INTERACTION WITH THEM
PRO PURCHASE BILLING, RESTORATION, REFUND, VERIFICATION, OR ACCESS ISSUES
LOSS OF PRO FEATURES OR ACCESS, INCLUDING LOSS OF OFFLINE PRO ACCESS
ANY PURCHASE MANAGEMENT SERVICES PROVIDED BY THIRD PARTIES
DATA LOSS, CORRUPTION, OR INABILITY TO ACCESS STORED INFORMATION
SECURITY BREACHES OR PRIVACY VIOLATIONS ON YOUR DEVICE
THIRD-PARTY SERVICE FAILURES OR CHANGES
YOUR MISUSE, MISUNDERSTANDING, OR INAPPROPRIATE USE OF THE APP
ANY OTHER MATTER RELATING TO THE APP, ITS CONTENT, OR OUR SERVICES

THE FOREGOING LIMITATIONS WILL APPLY WHETHER SUCH DAMAGES ARISE OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, VIOLATION OF STATUTE, OR OTHERWISE AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR COLORED PIXELS STUDIO WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST TWELVE (12) MONTHS, OR, IF GREATER, TWENTY-FIVE DOLLARS ($25). IF YOU HAVE NOT PAID US ANYTHING, OUR LIABILITY IS LIMITED TO ZERO DOLLARS ($0).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD OR FRAUDULENT MISREPRESENTATION, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. IF YOU ARE A CONSUMER, YOU MAY HAVE STATUTORY RIGHTS THAT CANNOT BE EXCLUDED, AND NOTHING IN THESE TERMS AFFECTS THOSE RIGHTS.

Apple App Store Additional Terms

The following applies if you obtained the app from the Apple App Store:

These Terms are between you and Colored Pixels Studio only, and not with Apple. Apple is not a party to these Terms
Colored Pixels Studio, and not Apple, is solely responsible for the app and its content
Apple has no obligation whatsoever to provide any maintenance or support services for the app
In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app
Apple is not responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including product liability claims, any claim that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation
In the event of any third party claim that the app or your possession and use of the app infringes that third party’s intellectual property rights, Colored Pixels Studio, and not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties
You must comply with any applicable third party terms of agreement when using the app
Apple and Apple’s subsidiaries are third party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary

Updates and Termination

At some point, we may wish to update the app. The app is currently available on Android and iOS – the requirements for system (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Colored Pixels Studio does not promise that it will always update the app so that it is relevant to you and/or works with the device version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms.

Pro Purchase Termination: If we terminate the app or Pro services, users may be entitled to refunds only according to the respective app store’s policies. We do not issue refunds directly and accept no liability for the loss of Pro access resulting from app discontinuation, platform changes, or third-party service termination.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of United States of America without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the App shall be instituted exclusively in the courts of United States of America. You consent to the jurisdiction of such courts and waive any objection to venue.

If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings in your local courts or to the benefit of mandatory consumer protection provisions, nothing in this section deprives you of those rights.

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

Waiver

The failure of Colored Pixels Studio to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Entire Agreement

These Terms constitute the entire agreement between you and Colored Pixels Studio regarding the use of the App and supersede all prior and contemporaneous written or oral agreements between you and Colored Pixels Studio.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
