You’re not allowed to attempt to extract the source code of the app, and you also shouldn’t try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Colored Pixels Studio.
Throughout this document, “Colored Pixels Studio,” “we,” “our,” or “us” refers to the individual owner/developer operating under the brand name “Colored Pixels Studio” and any affiliated parties who contribute to the development, maintenance, or operation of the Radius Around Me app.
Colored Pixels Studio is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.
When you install or use this app, it is assumed that you have gone through the Introduction section of this app. Colored Pixels Studio will not hold any responsibility if you do not find your desired feature(s) in the app or if the app doesn’t function as you want. Radius Around Me is a map-based visualization tool that allows users to draw custom circles and markers on Google Maps with advanced radius mapping capabilities, interactive circle analysis, smart location management features, address and place search, notes on circles and markers, and PDF map export. The App requires access to your device’s location services to provide its core functionality.

Radius Around Me offers a premium subscription service that removes advertisements and provides access to exclusive premium features including an ad-free experience, live location following, notes on circles and markers, filled circles, and PDF map export. By subscribing, you acknowledge that you understand how subscriptions work and agree to the billing terms of the Apple App Store.
The Radius Around Me app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak your device, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Radius Around Me app won’t work properly or at all.
All data is stored locally on your device. We do not access or collect your saved elements. Data will be lost if the App is uninstalled or if your device is reset. Address and place searches you perform are sent to a third-party geocoding provider (Geoapify) to return results and are not stored by us. PDF exports are generated on your device and are not uploaded to our servers.
The app does use third party services that declare their own Terms and Conditions.

Radius Around Me contains advertisements for free users. Premium subscribers will not see advertisements. The app displays full-screen interstitial advertisements only and does not display banner ads. By using the app, you acknowledge and agree that:

We want to inform you that whenever you use our Service, in a case of an error in the app we collect data and information (through third party products) on your phone called Log Data. This Log Data may include information such as your device Internet Protocol (“IP”) address, device name, operating system version, the configuration of the app when utilizing our Service, the time and date of your use of the Service, and other statistics.
This information is used solely for the purpose of maintaining and improving app functionality.

We want to inform users of this Service that these third parties have access to your Personal Information. The reason is to perform the tasks assigned to them on our behalf. However, they are obligated not to disclose or use the information for any other purpose.
You should be aware that there are certain things that Colored Pixels Studio will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Colored Pixels Studio cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.
If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.
Along the same lines, Colored Pixels Studio cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Colored Pixels Studio cannot accept responsibility.
Colored Pixels Studio will not take responsibility for any kind of data loss due to your device’s internal functionality. In case of an event such as device reset, iOS update issues, or if the data for Radius Around Me is cleared from the settings, etc., Colored Pixels Studio will not take any responsibility for this loss or to retrieve such data.
With respect to Colored Pixels Studio’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Colored Pixels Studio accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.
Map and Location Accuracy: Maps, satellite imagery, and location data may not be accurate or current. Factors including terrain, building structures, weather, and device limitations can affect accuracy. We accept no liability for any direct or indirect loss you experience from relying on the App’s location functionality or map data.
Address and Place Search: Address and place search is powered by a third-party geocoding provider (Geoapify). Search results, availability, and accuracy depend on that provider, and we accept no liability for results returned or for any decisions made based on them.
Location Permissions: The app only requests location access “While Using App” and does not track or store your location data. Location data is used exclusively for displaying your current position on the map and is not retained after app use. All location processing occurs locally on your device. The live location following feature (Premium only) repositions circles based on your current location while you actively use the app and does not track your location in the background or when the app is closed.
Calculation Accuracy: All distance, area, coordinate, and other measurements provided in the App are approximations. Due to the Earth’s curvature, map projections, and other factors, these calculations may not match actual real-world measurements. You should never rely on these calculations for:
Element Placement: Elements (circles, markers, etc.) placed on the map are static by default and will not follow your movement unless you explicitly enable the live location following feature (Premium only). Even with live location following enabled, circles only reposition while you actively use the app. We are not responsible for any confusion or errors resulting from misunderstanding this functionality.
Exported Documents: PDF maps exported from the App are generated on your device based on approximate measurements and coordinates and are provided for convenience only. Once you share or print an exported document, its distribution and use are your responsibility.
Advertising Content: We are not responsible for the content, accuracy, or appropriateness of any advertisements displayed in the App. Advertisements are provided by third-party services including Google AdMob and the Facebook Audience Network, which have their own terms and privacy policies.
Subscription Services: We are not responsible for billing issues, refund disputes, or payment processing problems, as these are handled by the Apple App Store. For subscription-related issues, please contact Apple’s customer support.
Premium Features: Premium features, including live location following, notes, filled circles, and PDF export, are provided as-is and may not function perfectly in all circumstances due to device limitations, location accuracy, or other technical factors. We are not responsible for any decisions or actions taken based on the use of premium features.
You agree not to use the App:
You agree to indemnify, defend, and hold harmless Colored Pixels Studio and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise from or relate to:

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, COLORED PIXELS STUDIO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
COLORED PIXELS STUDIO DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS IN THE APP WILL BE CORRECTED. COLORED PIXELS STUDIO DOES NOT WARRANT OR MAKE ANY REPRESENTATIONS REGARDING THE USE OR THE RESULTS OF THE USE OF THE APP IN TERMS OF THEIR CORRECTNESS, ACCURACY, RELIABILITY, OR OTHERWISE.
THIS DISCLAIMER APPLIES TO ALL FEATURES OF THE APP, INCLUDING BUT NOT LIMITED TO MAP VISUALIZATION, DISTANCE CALCULATIONS, CIRCLE FILL TRANSPARENCY, LIVE LOCATION FOLLOWING, ADDRESS AND PLACE SEARCH, NOTES, PDF MAP EXPORT, SUBSCRIPTION SERVICES, AND ANY OTHER FUNCTIONALITY PROVIDED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COLORED PIXELS STUDIO, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR, IF GREATER, FIFTY DOLLARS ($50).
At some point, we may wish to update the app. The app is currently available on iOS – the requirements for the system (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Colored Pixels Studio does not promise that it will always update the app so that it is relevant to you and/or works with the iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you. We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
We reserve the right to terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms.
Subscription Termination: If we terminate the app or subscription services, active subscribers will be notified with reasonable advance notice. Subscription billing will cease, and refunds, if any, will be handled according to the Apple App Store’s policies.
These Terms shall be governed by and construed in accordance with the laws of United States of America without regard to its conflict of law provisions. Any legal suit, action, or proceeding arising out of, or related to, these Terms or the App shall be instituted exclusively in the courts of United States of America.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
The failure of Colored Pixels Studio to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.
